General Terms of Use

I. Definitions & Application
These General Terms of Use apply to any use of the website www.immoreferences.be (hereinafter referred to as “the Website”). The site is administered and managed by sprl Immo Références, headquartered at Grand rue du Double Écot 23, 1380 Lasne, registered under the number BE0459.842.752 (hereinafter “the provider”).
The term “user” refers to any natural or legal person—whether registered or not—who visits the Website, views its content, downloads files, registers via forms, becomes a member, subscribes, or enters into a contract with the provider.
The provider and the user are collectively referred to as “the parties.”

By browsing, downloading, registering, subscribing, or contracting through the Website, the user formally, unconditionally, and without reservation accepts and agrees to comply with these General Terms. These terms apply to all consultations, orders, subscriptions, and contracts, and supersede any other general or specific terms.

The provider reserves the right to modify these terms at any time, without prior notice. Any such changes apply immediately to all use of the Website. Users are therefore advised to regularly review the latest version available at www.immoreferences.be.

II. Access & Use of the Website and Its Content
The Website may be accessed via computers with up‑to‑date software (browser, operating system, etc.). The provider does not guarantee compatibility and cannot be held responsible if parts or all of the Website are inaccessible or unusable. It is the user’s responsibility to ensure they have the necessary technical and possibly human means to connect to the Website.

When accessing the Website or its content, the user expressly agrees not to:

  • Seek unauthorized access to sections of the Website not publicly available.

  • Engage in any action that may disrupt the Website’s functionality.

  • Use automatic systems (e.g. robots, spiders, offline readers) aimed at causing denial-of-service attacks or altering participation mechanisms.

  • Display, download, send, or transmit content that is unlawful, harmful, harassing, defamatory, obscene, hateful, or otherwise offensive.

  • Mislead others by impersonating someone else.

Users must also take appropriate precautions to avoid malware infections, provide accurate registration data, and keep their login credentials confidential. Users remain solely responsible for their account activity. The provider may modify or suspend features at any time, without notice.

III. License
Users receive a non-transferable, non-sub-licensable, personal license to access and use the Website and its content for personal purposes only. Any commercial use—including reselling access, reproducing or distributing content, or creating hyperlinks—requires the provider’s prior, explicit consent.

IV. Intellectual Property & Industrial Rights
All aspects of the Website (concept, layout, code, images, logos, texts, databases, audiovisual works, etc.) remain the exclusive property of the provider and are protected by intellectual and industrial property rights. Users do not obtain any ownership rights through use.

The provider ensures its content does not infringe on third-party rights. However, any storage of Website content in a database beyond automatic browser caching is prohibited. By uploading content to the Website, users grant the provider a free and exclusive license to reproduce and use it across its platforms and media.

V. Liability

  • User Liability
    Users are responsible for their access, use and any associated damages or misuse. The provider is not liable for improper use of login credentials or user-generated content. The provider also has no control over, and is not responsible for, external sites linked from the Website.

  • Provider Liability
    The provider is only obliged to use reasonable efforts (“obligation of means”), and will not be liable for any direct or indirect damages arising from use of the Website. The provider strives to maintain accurate and updated content but offers no guarantees. Its liability is limited to cases of deliberate fault or gross negligence. The provider cannot be held responsible for downtime, service interruptions, or technical issues beyond its control. Users must install antivirus and firewall protections and exercise caution with data sharing. The provider is not liable for third-party messages, ads, or content on the site.

Miscellaneous Provisions
A. Data Protection – The provider commits to processing personal data lawfully and transparently. Users can consult the Privacy Policy for details.
B. Force Majeure – The provider is not liable for failure to fulfill obligations due to uncontrollable events such as natural disasters, epidemics, war, strikes, network failures, or other unforeseeable circumstances. If performance becomes impossible or excessively burdensome, the parties will negotiate adjustments in good faith. Failing agreement, either party may terminate the contract without compensation.
C. Severability – If any provision is invalid, the remainder stays enforceable; invalid parts will be replaced with economically equivalent provisions.
D. Headings – Section titles are for reference only and do not affect interpretation.
E. Entire Agreement – These terms, along with any contracts, constitute the full agreement between the parties, replacing any prior ones.
F. Applicable Law & Jurisdiction – Belgian law applies. In case of disputes, the parties should seek an amicable solution first. Otherwise, courts in the judicial district of Brussels will have jurisdiction.
